SA is awash with estate agents

There are nearly 70,000 estate agents in South Africa, almost 30,000 more than at democracy in 1994, according to the Estate Agency Affairs Board annual report tabled at Parliament.

The number of firms operating in the real estate market rose from 9,355 in 1994 to 15,175 this year, according to the report.

In total this year there were 69,100 estate agents including 15,728 principals and 53,372 salespersons, the report stated. In 1994 there were 40,420.

The report said that the increased figures - with those in the industry having risen from 64,546 in 2005 and up from 38,399 the previous year - indicated the buoyancy of the real estate market as well as the entry of members of historically disadvantaged groups into the industry.

Significantly the number of estate agents registered with the board dropped during the period when the rand came under pressure in the period 1998/1999.

The number of estate agents dropped from 35,662 in 1997 to 32,191 in 1998 to 28,833 in 1999. The number spiked to 32,837 in 2001, before falling again to
21,619 in 2002.

The report also noted that there had been 657 claims received by the board for theft or misappropriation of trust moneys by estate agents during the last financial year. This involved an amount of some 8.2 million rand.

The board is chaired by Nomonde Mapetla, who noted the "historic growth" in the number of estate agents. She said it was "conventional wisdom" that about a third of registered estate agents would drop out of the industry by the year-end.

Purchasers Cooling Off Right
The following guidelines are issued by the Estate Agency Affairs Board to assist estate agents in discharging their legal and ethical duties when negotiating a transaction which is subject to the cooling off right provided for by the Alienation of Land Act 68 of 1981 ['The Act']. Clause 2.1 of the Code of Conduct states that an estate agent may not ‘do or omit to do any act which is or may be contrary to the integrity of estate agents in general', while in terms of clause 2.2 an estate agent must protect a client's interests to the best of his or her ability, with due regard to the interests of all other parties concerned.

Failure to comply with the guidelines may constitute a contravention of these clauses, and/or the other clauses of the Code of Conduct referred to in the guidelines specifically.

Arbitration of Commission Disputes
The Arbitration of Commission Disputes provides a cost effective forum for the settlement of commission disputes, the Board has established a specialist Arbitration Tribunal.

Disputes regarding both the liability for and quantum of commission often arise between competing estate agents; estate agent and seller or two estate agents and a seller.
