What do you tell your client about applying for the that home?

  • Should they go to their local bank and apply there?
  • Should they phone the major financial institutions and do it by phone?
  • Should they apply online?
  • Or do you put them in touch with a mortgage originator?

If you want a home loan, your best chance of getting one is still through a mortgage originator. The move of our servers has been finalized and the dust has settled. All systems are go and we are very pleased with the faster responses on our servers and therefore better website performance, good news for you and good news for us.

To state the obvious, another year is rapidly coming to a close. These last few weeks are quieter than normal and it is an ideal time to wrap up outstanding work for 2011 and work towards a fresh new start in 2012.

Problems with sending of SMS messages

There have been issues with our SMS provider that has prevented messages from being sent out.

We have taken this issue up with them and they are looking into the problem and are trying to sort it out. They are also looking into a check system for us so we can minimize the “down time” of the system in the event of an issue

We can regretfully not inform all our clients if the system is down as it would take longer to create and send a bulk email than it would take to get our 3rd party provider to fix the issue.

Q&A Section

Q: How do I load more than one agent onto a property?

A: To do this, you need to load an agent team. This is done in the agent manager. First of all you need to load all your individual agent profiles. Eg. first load “Bob Smith’s” account, then load “Chris Watson’s” account. Then if you would like them to be in an agent team, you need to create a new profile. Make the agents name “Team Bob and Chris” or anything you would like. Then go to the box “is team” and tick it. Then click Team member selection and select Bob and Chris as agents for that team. Then on your property select “Team Bob and Chris” as the agent for both agents to display. Please note that on the individual agents profile, you must not tick ‘is team’ as an individual agent is not a team.

LACK OF ELECTRICITY AND RATES CLEARANCE CERTIFICATES HOLD UP SALES

Huge problems in the Gauteng area have been reported in “THE STAR” of late.

Investigate these early on in your sale. Don’t wait until the Seller has signed your sale agreement, having now locked the Buyer in from choosing another property, one which might or might be for less money.

Imagine how your buyer will feel if you go back two or three weeks later and say that the sale is being held up because of outstanding rates.

In this instance think of clause 2.3 of the Code of Conduct.

“An estate agent shall not in his capacity as an estate agent wilfully or negligently fail to perform any work and duties with such degree of care of skill as might reasonably be expected of an estate agent”.

Sometimes, this problem can be resolved. If there is enough equity in the sale, the Municipality can deduct the money that is owed from the sale proceeds. But what if there is not enough money to do this?

BEWARE – AGENTS WHO SELL BUSINESSES

If the sale of a business includes goodwill and the sale agreement does not contain an express restraint of trade provision, the seller is entitled to establish a new business and compete with the purchaser.

However, because the sale includes the goodwill of the business, the seller may not solicit his former customers to trade with his new business, even though this is not precluded by the sale agreement.

This important principle was recently reaffirmed by the Supreme Court of Appeal in the case of Van der Watt v Jonker.

The point that I want to make is who will get the blame? Will the Buyer say “Silly me – I should have read the agreement properly” or will he say to the agent “Why did you not make me aware of this?”

Again Clause 2.3 of the Code of Conduct springs to mind.

EAAB – NEWS Flash

CHEQUE PAYMENTS

All Estate Agency Affairs Board (EAAB) staff, estate agents and stakeholders and new applicants are hereby informed that, with effect from 1 December 2011, the EAAB will no longer be accepting any payments made by cheque.

Any one of the following alternative payment options may be utilised:

  • cash payments made directly at the cashier's desk;
  • POS payments using debit- or credit cards made at the cashier's desk;
  • EFT payments made directly into the relevant EAAB bank account;
  • direct deposits made into the relevant EAAB bank account.

N.B. Estate agents may only use the seven (7) digit reference number allocated by the EAAB when either making EFT payments or direct deposits to the EAAB (Estate agents are, if necessary, urged to communicate with the EAAB call centre at (011) 731 5600 to confirm the reference number before effecting any payments).

Failure to comply with the above procedures may result in a delay in the processing and allocation of payments.

The Estate Agency Affairs Board is calling all persons who have suffered monetary loss as a result of the abovementioned persons' failure to deposit and/or retain trust monies in a duly designated trust account, to lodge claims with the Estate Agent's Fidelity Fund.

All claims must be lodged by way of the Complaint Initiation Form which must be properly completed and deposed to before a Commissioner of Oaths.

Your Complaint Initiation Form must be accompanied by the following documents:

  • Proof of payment of the monies in question to the estate agent concerned;
  • A copy of the relevant lease agreement;
  • If you are a tenant claiming a deposit, a signed letter of consent from the landlord confirming that you are entitled to a refund of the full deposit;
  • If you are a landlord claiming a deposit, evidence that:
  • You have incurred expense as a result of damages caused by the tenant;
  • You have reimbursed the deposit to the tenant; or
  • The tenant has consented to the deposit being paid over to you.
  • All claimants must verify in their Complaint Initiation Form that they have not received the monies claimed.

Please note that failure to lodge a claim within three months of the date on which you became aware, or by the exercise of reasonable care, should have become aware, of the estate agent's failure to keep trust monies in trust, may result in rejection of your claim.

Rental news - Debt recovery is a lengthy expensive process

It is surprising, but true, that there are many sectional title property owners who still do not appreciate exactly why monthly levy collection is essential, says Michael Bauer, General Manager of the property management company IHFM.

“The simple truth, which the owner of every freestanding property knows, is that on any property there will be maintenance and operating expenses. In a sectional title scheme it is perfectly logical that if your unit comprises say 5% or 10% of the entire floor space, you should pay 5% or 10% of the running costs - but on certain schemes there will always be a small handful of owners who cannot or will not acknowledge this.”
